As Mr. Miller has previously advised, this is a "back-door approach" to jam the renewable mandate through in California, vs attempting to pass a legislative mandate. We will have to see if it stands up to the substantial legal challenges forthcoming, not withstanding the fact that California does not have the "physical capability" of meeting a 33% renewable energy target with "in state" generation. California will have to go across the State borders to Arizona, Nevada, Utah and Oregon if Transferable Renewable Energy Credits are allowed, which is also subject to legal challenge.
